2- WHAT TYPE OF PERSONAL DATA DO WE PROCESS AND FOR WHAT PURPOSE?

2.1. Types of personal data we process

In compliance with data protection regulations, BDTRANS will only process those data that are essential, minimizing the processing of data on your part. We may carry out the following data processing and process the following categories of personal data:

To carry out the necessary administrative and commercial procedures, as well as to comply with the corresponding legal obligations.

Send commercial communications, if you are our customer or if you have expressly consented to the sending of such communications by electronic means.

3- WHAT IS THE LEGITIMACY FOR THE PROCESSING OF YOUR DATA?

The legal basis that legitimizes the processing of your personal data is your express consent given to carry out the purposes described above, which will be requested at the time you request information from us, or by checking the appropriate box when providing your data in any of our personal data collection forms.

In the event that you contract our services, a contractual relationship will be generated between you and BDTRANS that will constitute the legal basis that will legitimize the processing of your personal data for the execution of said contractual relationship, as well as, if applicable, the fulfillment of the corresponding legal obligations.

In case you do not provide us with your personal data or in case you do not accept the present privacy policy, BDTRANS will not process your personal data, but it may also mean the impossibility of receiving information about BDTRANS products and services and, in any case, the impossibility of contracting our services.

The legal basis that legitimizes the processing of our employees’ data is the execution of the employment relationship and the fulfillment of the corresponding obligations.

The legal basis that legitimizes the processing of images captured by our video surveillance cameras is our legitimate interest in the surveillance, control and security of our facilities.

The legal basis that legitimizes the processing of data provided through our internal information system is the fulfillment of the legal obligation to provide and manage such system.

4- CONSERVATION PERIOD How long will we keep your data?

The personal data you provide us will be kept for the time necessary to manage the information you request from us, as well as to manage the services you request from us or, for the fulfillment of any contract that is generated between BDTRANS and you or third parties, or the fulfillment of the legal obligations that affect us.

The personal data of our employees will be kept for the duration of their employment relationship with BDTRANS and, thereafter, for the legally stipulated periods of time.

Once the data has served the purpose for which it was collected, we will delete it permanently. However, we will keep your data for a longer period of time in case it is necessary for the fulfillment of legal or registry obligations. Likewise, it may be necessary to keep them for the time necessary for the prescription of the contractual or legal responsibilities that are generated.

The data you provide us to initiate a selection process will be kept for a maximum period of one year. Subsequently, if you have not joined BDTRANS or you are not part of a selection process, they will be deleted and we will not keep a copy.

The images recorded by our video surveillance system will be automatically deleted in a maximum of 30 days, unless they must be kept, duly blocked for a longer period of time, due to an investigation or court order.

5- TO WHICH RECIPIENTS WILL YOUR DATA BE COMMUNICATED?

Within BDTRANS your personal data will be processed by duly authorized personnel, and, if necessary or practical to fulfill the purposes stated above, may be processed, where appropriate, by third parties.

The categories of recipients to whom your Personal Data may be disclosed are as follows:

Named third party processors, such as IT providers, consultants and advisors and other companies providing ancillary services, especially will be communicated to JOAN COLLELL PASCUAL, S.L, a company of the Barcelonesa Group to which our company belongs and which provides various central services.

7-CLAIM BEFORE THE SUPERVISORY AUTHORITY:

In case you consider that BDTRANS has violated any of your rights protected by the personal data protection regulations or that BDTRANS has violated any obligation regarding the protection of Personal Data, you have the right to submit a complaint to the competent supervisory authority, which in Spain is the Spanish Data Protection Agency located at Calle Jorge Juan, 6. 28001 – Madrid.

8-LEGISLATION AND JURISDICTION

This privacy policy is governed in each and every respect by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

It is also governed by the Organic Law 3/2018 of December 5, 2018, on the Protection of Personal Data and guarantee of digital rights. Likewise, our website is governed by Law 34/2002, of July 11, 2002, on information society services and electronic commerce.

The language applicable to this Privacy Policy is Spanish. Therefore, in the event of any contradiction in any of the versions provided in other languages, the Spanish version shall prevail.

10- DATA PROTECTION OFFICER

BDTRANS has a Data Protection Delegate who will perform the following functions:

  • To inform and advise BDTRANS on the obligations it must carry out to comply with data protection regulations.
  • To supervise that BDTRANS suppliers comply with the requirements of the data processor contracts and, in short, with the personal data protection regulations.
  • Supervise the application of data protection regulations in BDTRANS .
  • Ensure the correct conservation of the documentation related to the protection of personal data.
  • Oversee the documentation, notification and communication of personal data breaches.
  • To act as a point of contact with the supervisory authority of each country in which BDTRANS has a presence on issues related to the processing.
  • To supervise the response to requests from the supervisory authority, as well as to cooperate with it when required to do so.
